Lovely Co ("we", "us", "our") respects your privacy. This policy explains what personal information we collect when you visit lovelyco.co.za or buy from us, why we collect it, how we protect it, and the rights you have under the Protection of Personal Information Act 4 of 2013 (POPIA).

1. Who is responsible for your information

2. What information we collect

  • Information you give us: your name, email address, phone number, delivery and billing address, order details, and any messages you send us (by email, phone or live chat).
  • Information collected automatically: your IP address, device and browser type, pages viewed, how you interact with our website, and how you found us. We collect this using cookies and similar technologies.
  • Payment information: payments are processed by Peach Payments. We do not see or store your full card details.

3. Why we use your information

We only use your personal information for lawful purposes, including to:

  • process, deliver and support your orders, returns and refunds;
  • communicate with you about your order or your questions;
  • prevent fraud and keep our website secure;
  • understand how our website is used so we can improve it;
  • send you marketing emails or messages, but only if you have opted in; and
  • meet our legal and tax obligations.

4. Who we share it with

We never sell your personal information. We only share it with trusted service providers who help us run our business, and only as much as they need:

  • Shopify, which hosts our online store;
  • Peach Payments, which processes payments;
  • The Courier Guy (including PUDO), which delivers orders and handles returns;
  • advertising platforms such as Google and Meta, if you have allowed marketing cookies; and
  • authorities, where we are required to do so by law.

These providers must keep your information secure and may only use it for the services they provide to us.

5. Information sent outside South Africa

Some of our service providers (such as Shopify, Google and Microsoft) store information on servers outside South Africa. When this happens, we only use providers that are bound by laws, contracts or policies that give your information a level of protection similar to POPIA.

6. Cookies

We use cookies to make our website work (for example, to remember your cart), to understand how visitors use it, and, with your consent, for marketing. You can manage your cookie choices in the cookie banner or in your browser settings. Blocking some cookies may affect how the website works.

7. Marketing

We only send marketing emails or messages if you have agreed to receive them. You can unsubscribe at any time using the link in any marketing email, or by emailing info@lovelyco.co.za.

8. How long we keep your information

We keep your personal information only for as long as we need it for the purposes above. Order and transaction records are kept for at least 5 years, as required by South African tax law. After that, the information is securely deleted or anonymised.

9. How we protect your information

We take reasonable technical and organisational steps to protect your personal information from loss, misuse and unauthorised access. Our website uses encrypted (SSL) connections and payments are processed through a secure payment provider. If we become aware of a data breach that affects you, we will notify you and the Information Regulator as required by POPIA.

10. Your rights

Under POPIA, you have the right to:

  • ask whether we hold personal information about you and request a copy of it;
  • ask us to correct or update information that is inaccurate or incomplete;
  • ask us to delete your information, where we are not legally required to keep it;
  • object to us using your information, including for marketing; and
  • lodge a complaint with the Information Regulator.

To make a request, email info@lovelyco.co.za. We may ask you to confirm your identity before we act on your request, and we will respond within a reasonable time.

If you have a concern about how we handle your personal information, please contact us first at info@lovelyco.co.za so we can try to resolve it. You also have the right to lodge a complaint with the Information Regulator (South Africa): inforegulator.org.za.

12. Children

Our website is not intended for children under 18, and we do not knowingly collect personal information from children without the consent of a parent or guardian.

We may update this policy from time to time. The latest version will always be available on this page.
